Welcome to Kapito. By downloading, installing, or using the Kapito application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using Kapito, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Description of Service
Kapito is a personal finance application that allows you to manually track your net worth, assets, and liabilities. The App provides tools for:
- Recording and tracking financial accounts
- Visualizing net worth over time
- Analyzing financial data through charts and insights
- Syncing data across devices via iCloud (optional)
3. Not Financial Advice
Important: Kapito is a tracking and visualization tool only. The App does not provide:
- Financial advice
- Investment recommendations
- Tax guidance
- Legal advice
Any insights, charts, or analysis provided by the App are for informational purposes only. You should consult qualified professionals for financial, investment, tax, or legal advice.
4. User Responsibilities
You are responsible for:
- The accuracy of data you enter into the App
- Maintaining the security of your device and Apple ID
- Complying with all applicable laws when using the App
- Backing up your data if desired
5. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:
- Copy, modify, or distribute the App
- Reverse engineer or decompile the App
- Use the App for any unlawful purpose
- Sublicense, sell, or transfer your rights to use the App
6. Subscriptions and Purchases
Free Tier
Kapito offers a free tier with limited features. Free users can track up to 5 accounts with basic functionality.
Pro Subscription
Kapito Pro is available as a subscription that unlocks all features. Subscriptions are processed through the Apple App Store and are subject to Apple's terms:
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
Refunds
Refunds are handled by Apple according to their refund policy. Please contact Apple Support for refund requests.
7. Data and Privacy
Your use of the App is also governed by our Privacy Policy. We do not collect, store, or have access to your financial data.
8. Third Party Services
The App may integrate with third-party services (such as price data providers). These services are subject to their own terms and privacy policies. We are not responsible for the accuracy or availability of third-party data.
9. Intellectual Property
The App, including its design, features, code, and content, is owned by Kapito and protected by intellectual property laws. The Kapito name, logo, and branding are trademarks of Kapito.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF DATA
We do not warrant that the App will be uninterrupted, error-free, or secure.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAPITO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits or revenue
- Loss of data
- Financial losses from decisions made using the App
- Any other intangible losses
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Kapito from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
13. Termination
We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may terminate your use of the App at any time by deleting it from your device.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles.
16. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Singapore.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kapito regarding the use of the App.
